President’s Choice Financial MasterCard Exclusive Access Contest (the “Contest”) Official Rules

NO PURCHASE NECESSARY. CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF ONTARIO, CANADA WHO ARE 18 YEARS OF AGE OR OLDER. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST HAVE READ AND AGREED TO THE FOLLOWING CONTEST RULES. PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.

1. CONTEST PERIOD:

The contest starts at 6:00 pm EST on June 13, 2010 and closes at 6:00 pm EST on October 4, 2010.

2. ELIGIBILITY:

The Contest is open only to legal residents of Ontario, Canada who are 18 years of age or older at the time of Contest entry. Employees, their immediate families (and those with whom they are domiciled) of President’s Choice Bank (the “Contest Sponsor”), Loblaw Companies Limited (“LCL”), the Toronto Argonauts Football Club (the “Argonauts”) and their respective subsidiaries, affiliates, directors, officers, shareholders and agents are not eligible to enter.

3. HOW TO ENTER:

NO PURCHASE NECESSARY TO ENTER OR WIN. There is a maximum of one (1) entry per person. Multiple entries by the same person or from the same email address or from the same person from different email addresses in shall result in disqualification. To enter the Contest, visit www.Argonauts.ca/access to fully complete and submit the online entry ballot. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. In the event of any dispute as to the identity of the entrant for purposes of online entry, online entries shall be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry, provided the authorized account holder is an eligible entrant. "Authorized account holder" is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (i.e., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winners may be requested to provide the Sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Although Internet access and an e-mail account are required in order to participate in the Contest, no purchase of any kind is required. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e-mail accounts.

To be eligible, all entries must be received by no later than 6:00 p.m. EST on October 4, 2010 (the “Draw Deadline”).

4. THE PRIZE:

There are seven (7) Prizes available to be won, each consisting of:

·         One (1) dinner with premier Toronto Argonauts players on Thursday, October 28, 2010 at a restaurant of the Sponsor’s choosing for the Winner and one guest

·         One (1) overnight hotel stay on Thursday, October 28, 2010 in downtown Toronto (one standard double-occupancy room).

·         Return transportation between the hotel and restaurant      

·         One (1) pre-game field tour for the Winner and one guest on Friday, October 29, 2010

·         One (1) VIP suite viewing of the last Toronto Argonauts 2010 regular season home game on Friday October 29, 2010 for the Winner and one guest

The approximate retail value of each Prize is $1,000 Cdn. Each entrant is eligible to win only one (1) Prize.

Each Prize includes only the items specifically listed above and does not include such additional costs as travel between the Winner’s (and guests’) place of residence and Toronto, hotel charges other than accommodation (e.g. telephone, fax or cable charges, mini-bar or other hotel services), other meals, gratuities or spending money. Any additional costs incurred in collecting and using the Prize are the Winner’s sole responsibility.

Each Prize must be accepted as awarded, is not transferable, and will not be awarded in a cash equivalent except at the sole discretion of the Sponsor. All guests must be of the age of majority in their respective province or territory of residence. Due to the nature of the Prize, no alternative dates are available. If a selected entrant chooses not to accept the Prize or is unable to travel at the designated times, that Prize will be forfeited by that entrant and the Sponsor reserves the right to select another eligible entrant at random as a possible winner. In the event that a Prize, or any component thereof, is unavailable for any reason, the Sponsor reserves the right in its sole and absolute discretion to substitute a Prize or Prize component of equal or greater value, including without limitation a cash award.

5. THE DRAW:

On or about October 5, 2010 at 12:00 noon EST, a random draw of one entry for each of the Prizes will be made at 355 King Street West in Toronto, by the Contest judges (the “Judges”), who may be employees or independent contractors of the Sponsor or the Argonauts, from all entries received by the Draw Deadline. The chance of being selected depends on the total number of eligible entries.  Within 24 hours after the Draw Deadline, representatives of the Sponsor will attempt to contact each selected entrant, for a period of approximately three (3) business days (Monday to Friday) including daytime and evening hours. If the Sponsor’s representatives are not able to make contact and speak directly with a selected entrant within the allotted time, that selected entrant will be disqualified and shall not be entitled to receive any prize, and the Sponsor reserves the right, in its sole and absolute discretion, to select at random another eligible entrant from the remaining eligible entries, whom the Sponsors shall attempt to contact, and who shall be subject to disqualification, in the same manner. Telephone and email contact will be attempted using the telephone number(s) and/or email address provided in the Contest entry. None of the Released Parties as described below will be responsible for the failure for any reason whatsoever of any selected entrant not receiving notification or for any selected entrant not being able to respond to this notification or complete their confirmation of winning as required. The Prizes will be awarded only to those selected entrants whose entries are drawn and who become confirmed winners in accordance with these official Contest rules.

6. TO WIN:

If your entry is drawn and you otherwise comply with these Contest rules, you will be required to correctly answer, unaided, a time-limited, mathematical skill-testing question in a pre-arranged telephone interview in order to be declared a Winner and be awarded the Prize. If you do not answer correctly or if you do not otherwise comply with these Contest Rules, you will be disqualified and will not receive the Prize. In such a case, the Sponsor reserves the right, in its sole discretion, to cause the Judges to conduct a new draw for that Prize from among the remaining eligible entries. 

To be confirmed as the winner of the Prize, you must also have complied and continue to be in compliance with these official Contest rules; you must execute and return President’s Choice Bank’s Affidavit of Eligibility, and both you and your Guest must execute and return President’s Choice Bank’s Liability Release and Publicity Release to President’s Choice Bank and/or their agent within 10 days of the date the material was sent. If any guest is a minor, the recipient of the Prize must have the guest’s parent or legal guardian sign a declaration and release form on behalf of the minor.   

Non-compliance with any of the foregoing may result in disqualification and, at the sole discretion of the Sponsor, awarding of the Prize to an alternate winner.

7. GENERAL:

By entering this Contest, each entrant agrees to provide such personal information as is reasonably necessary for the administration of this Contest. In addition, each Winner and his/her guest (or the parent/guardian of any guest who is a minor) must agree that:

1.        President's Choice Bank, George S. Weston Ltd., Loblaw Companies Limited, Toronto Argonauts Football Club, and each of their respective parent companies, affiliates, subsidiaries, advertising or promotional agencies and entities related to the management, coordination or fulfillment of the Prize (collectively, “Released Parties”) shall have the right and permission to use his or her name, voice, city/province/territory of residence, photograph, comments and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission, or notification; and;

2.        Released Parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be held harmless for any liability, loss or injury to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a Prize (including Prize activity related thereto) or participation in this Contest.

All decisions of the Sponsor and/or the Judges are final and binding on all entrants, without right of appeal, with respect to all aspects of the Contest, including without limitation eligibility and/or disqualification of entries.

All entries become the property of the Sponsor and none will be returned.  The Sponsor assumes no responsibility for lost, stolen, delayed, illegible, damaged, destroyed or misdirected entries. The Sponsor is not responsible in any way for damage, loss or injury resulting from computer, telephone or network malfunctions.

The Sponsor, its affiliates and agencies and their respective directors, officers and employees shall assume no liability of any kind whatsoever for any failure, in whole or in part, of the website (argonauts.ca) during the Contest period, including any problems or technical malfunction of any telephone, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the telephone, or any combination thereof including any injury or damage of any computer related to or resulting from downloading any material related to the Contest, all of which may affect a person’s ability to participate in the Contest.

The Sponsor, its affiliates and agencies and their respective directors, officers and employees shall assume no liability of any kind whatsoever resulting from (i) late-received or incomplete entries; or (ii) entries which otherwise fail to comply with these Official Contest Rules.

The Sponsor reserves the right to terminate, modify or suspend the Contest for any reason in its sole discretion and without notice, including if events beyond its reasonable control make continuation unfeasible.  The Sponsor also reserves the right to terminate or suspend the contest, should a virus, bug, or computer, electronic or system malfunction, or other cause beyond its control, corrupt the administration, security or proper play of this contest.  This contest is subject to all relevant laws.

Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Sponsors reserve the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.

Any Prize pictured in any advertising or other promotion materials is for illustrative purposes only. Actual Prize may vary from the Prize pictured. All Prize details, and any restrictions related to any Prize or Prize component, will be provided to the applicable Prize Winner upon the award of the prize. No Prize will be awarded to any participant who fails in any way to comply fully with these Official Rules.

If, at the time a Prize is redeemed or awarded, the actual prevailing retail value of the Prize is less than the approximate retail value stated by the Sponsors in any point of sale, television or print advertising, Contest materials, and/or in these Official Rules, the prize Winner will not be entitled to the cash difference in value.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

8. PRIVACY:

Other than as provided in these Contest rules, unless a participant otherwise consents, all personally identifying information submitted for this Contest in your contest entry ballot or mail-in entry will be used only for the purpose of conducting this Contest. The President’s Choice Financial privacy policy can be obtained at www.pcfinancial.ca. The Toronto Argonauts Football Club privacy policy may be obtained at www.argonauts.ca.
